These Terms of Business ("Terms") govern the relationship between Phoenix Tax Accountancy Ltd ("we", "us", "our", "the Firm") and the client ("you", "the Client") for the provision of tax, accountancy, and related professional services. By submitting an enquiry form, engaging our services, or instructing us to act on your behalf, you confirm that you have read, understood, and agreed to these Terms in their entirety.

1. About Us

Phoenix Tax Accountancy Ltd is a professional accountancy practice registered in England and Wales. Our registered office is at Denning House, Suite 204, 1A George Street, Wolverhampton, WV2 4DP. We provide Self Assessment tax return filing, Making Tax Digital for Income Tax Self Assessment (MTD ITSA) compliance, CIS (Construction Industry Scheme) refund claims, bookkeeping, and general tax advisory services to self-employed individuals, sole traders, and small businesses across the United Kingdom.

2. Enquiries and Contact Consent

By completing and submitting our online enquiry or consultation form, you:

  • Voluntarily provide your personal contact details including name, email address, and telephone number
  • Explicitly consent to Phoenix Tax Accountancy Ltd contacting you by email, telephone, and/or WhatsApp to respond to your enquiry, discuss your tax requirements, and provide information about our services
  • Acknowledge that this contact is made in direct response to your voluntary submission of the enquiry form on our website or campaign page
  • Understand that submitting an enquiry form does not create a binding contract for services — a formal engagement letter will be issued separately if you proceed
  • Confirm that the information you have provided is accurate and complete to the best of your knowledge

We will always handle your contact details in accordance with our Privacy Policy and UK GDPR.

3. Engagement and Scope of Services

Our formal engagement commences upon your written acceptance of our engagement letter and payment of any applicable fee or deposit. The scope of work will be clearly defined in the engagement letter and may include:

Self Assessment Tax ReturnPreparation and submission of your annual Self Assessment return to HMRC for the relevant tax year(s)
MTD ITSA ComplianceSetup, quarterly digital record-keeping, and submission of updates under Making Tax Digital for Income Tax
CIS Refund ClaimsPreparation and submission of CIS deduction refund claims for construction sub-contractors
BookkeepingRecording and reconciling your income and expenses for tax purposes
Tax AdvisoryGeneral advice on allowable expenses, tax planning, and HMRC correspondence

Any services outside the agreed scope will be subject to a separate quotation and written agreement.

4. Client Obligations

To enable us to provide our services effectively and on time, you agree to:

  • Provide all information, documents, and records requested by us promptly and in full
  • Ensure that all information provided to us is accurate, complete, and not misleading
  • Notify us immediately of any changes to your circumstances that may affect your tax position
  • Respond to our communications within a reasonable time (we recommend within 5 working days)
  • Retain your own copies of all documents provided to us and all returns submitted on your behalf
  • Inform us of any HMRC correspondence, enquiries, or penalties you receive

We cannot be held responsible for errors, omissions, or penalties arising from incomplete, inaccurate, or late information provided by you.

5. Fees and Payment

Our fees are agreed in advance and set out in your engagement letter. Our standard pricing for Self Assessment services is as follows:

Complex / Higher Turnover ReturnsFrom £400+ — for higher turnover, multiple income streams, or property income
MTD ITSA Quarterly FilingPriced separately — contact us for a bespoke quote

All fees are quoted exclusive of VAT where applicable. Payment is due upon completion of the work unless otherwise agreed. We reserve the right to withhold submission of returns until fees are settled in full. We accept payment by bank transfer, debit/credit card, and other methods as agreed.

We reserve the right to review and adjust our fees annually. Any changes will be communicated to you in writing before they take effect.

6. Deadlines and HMRC Penalties

HMRC imposes strict deadlines for Self Assessment tax returns and MTD ITSA submissions. Key deadlines include:

Self Assessment paper return31 October following the end of the tax year
Self Assessment online return31 January following the end of the tax year
Payment of tax due31 January (and 31 July for payments on account)
MTD ITSA quarterly updates5 August, 5 November, 5 February, 5 May

We will use reasonable endeavours to meet all deadlines, provided you supply us with the required information in good time. We recommend providing all documents to us at least 4 weeks before the relevant deadline. We cannot accept responsibility for penalties arising from late provision of information by you, or from circumstances beyond our reasonable control.

7. Confidentiality

Phoenix Tax Accountancy Ltd treats all client information as strictly confidential. We will not disclose your personal or financial information to any third party without your prior written consent, except where required by law (including HMRC obligations), by a court order, or by our professional regulatory body. Our staff are bound by confidentiality obligations.

8. Limitation of Liability

Our liability to you for any loss or damage arising from our services is limited to the fees paid by you for the specific service giving rise to the claim. We are not liable for any indirect, consequential, or special losses, including loss of profit, loss of data, or HMRC penalties arising from circumstances outside our control or from inaccurate information provided by you. Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence.

9. Termination

Either party may terminate the engagement by giving 14 days' written notice. Upon termination, you remain liable for fees in respect of work completed up to the date of termination. We will return your documents and records promptly upon settlement of all outstanding fees. We reserve the right to terminate the engagement immediately if you provide false information, fail to pay fees, or engage in conduct that puts us in breach of our professional obligations.

10. Complaints Procedure

We are committed to providing a high-quality service. If you are dissatisfied with any aspect of our work, please contact us in writing at [email protected]. We will acknowledge your complaint within 5 working days and aim to resolve it within 28 days. If we are unable to resolve your complaint to your satisfaction, you may be entitled to refer the matter to an appropriate professional body or the Financial Ombudsman Service where applicable.

11. Governing Law

These Terms of Business are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Amendments

We reserve the right to update these Terms of Business from time to time. The current version will always be available on our website. Continued engagement of our services following any update constitutes your acceptance of the revised Terms.
